TRUCKER INDICTED IN FATAL ACCIDENT

Late-Night Accident Claimed the Lives of Two Women

WHEATONDuPage County State’s Attorney Joe Birkett announced today that a DuPage County Grand Jury has returned a six-count indictment against a truck driver stemming from a late-night accident that claimed the lives of two women.

            Named in the indictment is Glen L. Hosey, 49 (d.o.b. 8/9/56), of 835 Wyndstone Drive, Elwood, Illinois.  Hosey is charged with four counts of Driving in Excess of Maximum Driving Time for Property Carrying Vehicle, a Class 4 Felony, Improper Lane Usage and Failure to Reduce Speed. 

            On April 18, 2005, just before midnight, while working for Partners Trucking, 2068 E. 7750 S. Road, Chebanse, Illinois, Hosey was driving his tractor-trailer westbound on I-88 between Winfield Road and Route 59.  According to the indictment, Hosey allegedly maneuvered his truck into the victim’s vehicle, which was traveling along the left side of Hosey.  The impact sent the victim’s vehicle into a median killing two of the six passengers.  The indictment alleges that Hosey was driving his truck more than fourteen hours at one time between ten-hour breaks as required by State and Federal law. 

            “The investigation into this crash revealed that Mr. Hosey was allegedly operating his vehicle over the allowed operation time without proper rest in between,” remarked Birkett.  “These laws are on the books for a reason, for the safety of the general public and to protect the health and well-being of truck drivers themselves and the motoring public as well.”

Members of the public are reminded that this complaint contains only charges and is not proof of the defendant’s guilt.  A defendant is presumed innocent and is entitled to a fair trial in which it is the government’s burden to prove his or her guilt beyond a reasonable doubt.
