Wireless Telecommunication Facility Permits

Effective June 26, 2018, the Division of Transportation has adopted a new ordinance, "Wireless Telecommunications Facilities Ordinance"  #DT-O-0037-18.  This ordinance allows for the installation of Wireless Telecommunication Facilities on existing, new, privately or publicly-owned structures within the County Highway right-of-way.  The ordinance was developed in accordance with the Small Wireless Facilities Deployment Act, PA 100-0585.

Application Process

Applications must be submitted using the application form provided below.  A completed checklist is required with each application which lists the requirements for all applications.  Please note that incomplete applications will be denied.  If an application is deemed to be incomplete, DOT staff will notify the applicant within 10 days including a list of any items missing from the application.  

Application Requirements

All applications:        

  • Site specific structural loading analysis;
  • A line-of-sight analysis;
  • A location map showing where each proposed wireless telecommunication facility or structure would be installed;
  • Photographs of the location and its immediate surroundings depicting the structure on which each proposed wireless telecommunication facility would be mounted or location where structures would be installed as well as the existing conditions prior to the proposed installation. Photographs should be taken within 6 months prior to submitting an application;
  • Exhibit showing the location where each facility would be installed, including height, off-sets and volumetrics (cubic ft) for each of the system components;
  • Specifications and drawings prepared by a structural engineer for each proposed wireless telecommunication facility covered by the application as it is proposed to be installed;
  • A proposed schedule for the installation and completion of each wireless telecommunication facility covered by the application, if approved;
  • Engineer’s estimate of the cost of all required work, including restoration;
  • Certification that the collocation complies with the DuPage County Wireless Telecommunication Facilities Ordinance, Frequency Interference Requirements, to the best of the applicant’s knowledge;
  • ­­­­­Legally competent evidence of the consent of the owner of the structure that a collocation is proposed upon (for installation on non-County owned infrastructure);
  • Application Fee per the fee schedule provided in the Ordinance;

If co-located on County owned infrastructure:

  • A make-ready analysis prepared by a structural engineer;
  • An executed Pole Attachment Agreement (prior to permit issuance);
  • Separate agreement(s) with any other collocators to reimburse for costs incurred due to proposed relocation, if applicable.

Fees

All applications for permits pursuant to this Ordinance shall be accompanied by a non-refundable application fee according to the current fee schedule, or in accordance with applicable federal or state law:

For permitted collocation of Wireless Telecommunication Facilities on County owned infrastructure, an Annual Recurring Fee will be assessed for each permitted location of two hundred ($200.00) dollars per year or an amount equal to the County’s direct costs, whichever is greater.  Initial payment shall be received prior to permit issuance by the County.  Thereafter, payment shall be received annually beginning on the second March 1st following the initial payment. (Example:  If initial payment is on January 1, 2019, the next payment is March 1, 2020, and the third payment is March 1, 2021.)
